Frontex, as an EU Agency, applies procurement procedures prescribed in  the EC Financial Regulation (Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities, as last amended), Title V Procurement.

 

The choice of the tender procedure and advertising depends mainly on the threshold amounts as follows:

Means of advertising

<€5,000

 negotiated procedure with single supplier/service provider

 No advertising

€5,001 - €25,000

negotiated tender procedure –  with at least 3 candidates

No advertising

€25,001 - €60,000

Negotiated tender procedure – with at least 5 candidates

Advertising on Frontex Webpage

>€60,000 and less than €125,000 for supplies and services 

restricted tender procedure or, if considered  appropriate, open procedure

 TED Webpage[1] and Frontex Webpage

>€125,000 supplies and services

open tender procedure or restricted tender procedure with  a contract notice  published in the OJ

Service contracts >€60,000 with no upper limit)

negotiated procedure following a publication of a contract notice in the OJ

or restricted tender procedure following a call for expressions of interest
